Terms of Service

These Terms govern your use of Tactical (the "Service"), provided by Tactical ("we", "us", "our"). By creating an account, installing our app on a third-party platform (Shopify, WordPress/WooCommerce, etc.), or pasting the Tactical snippet on a storefront you operate, you agree to these Terms. If you don't agree, don't use the Service.

01Acceptance of these terms

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a contract. If you're using Tactical on behalf of a company, you represent that you're authorised to bind that company.

02What Tactical does

Tactical classifies traffic on your storefront, distinguishing AI-agent visitors (e.g. ChatGPT, Perplexity, Claude, Google AI) from human visitors and ambiguous traffic. The Service produces dashboards, alerts, and aggregate reports based on behavioural signals captured by a JavaScript snippet you install on your storefront, or by webhooks delivered from a connected commerce platform.

Tactical is an analytics service. We do not host your storefront, fulfil orders, handle payments to your customers, or modify your storefront's pricing or inventory. Decisions you make based on Tactical's reports remain yours.

03Your account

• You're responsible for keeping your password and API keys confidential. Notify us at [email protected] if you suspect unauthorised use.
• One account per person. You may add additional stores under a single account using the multi-store feature in the dashboard.
• You're responsible for all activity that occurs under your account, including any unauthorised use of your API keys.
• You agree to provide accurate information during signup and to keep it current.

04Acceptable use

You agree not to:

• Use Tactical to track storefronts you don't own or operate, or to analyse competitors without their consent
• Reverse-engineer, decompile, or attempt to extract source code from the Service except where local law permits
• Resell, sublicense, or white-label the Service without our written agreement
• Use the Service to violate applicable law (including data protection, anti-spam, or competition law)
• Interfere with the Service's operation — flood our endpoints, attempt to bypass rate limits, or probe for vulnerabilities outside a coordinated disclosure (see [email protected] if you find one — we'll work with you)
• Use the Service to collect or process special-category personal data (health, biometric, etc.) under GDPR Article 9 — Tactical is not designed to handle that scope

05Subscription & billing

• Tactical offers a free Scout tier and paid tiers (Radar, Command, Autopilot when launched). Pricing is shown on the pricing page and reflected at checkout.
• Paid plans bill monthly or annually in advance via Dodo Payments (for the standalone product) or Shopify Billing (for the Shopify app). Annual plans are pro-rated on cancellation.
• You can cancel at any time from /dashboard/billing. Cancellation takes effect at the end of the current billing period.
• If a payment fails, we may suspend access to paid features. Free-tier features remain available.
• We may change pricing for future billing periods with at least 30 days' notice via email. Existing pre-paid annual plans are honoured at the original price until renewal.
• Refunds: month-to-month subscriptions are not refunded mid-cycle. Annual subscriptions cancelled within 14 days of activation receive a pro-rata refund. We may make exceptions in good faith.

06Your data, your IP

You retain all rights to data collected from your storefront ("Customer Data") and to any reports, dashboards, or exports we generate from it. You grant Tactical a worldwide, non-exclusive licence to process Customer Data solely to operate and improve the Service for you.

We may use aggregated, de-identified analytics across many merchants (e.g. "% of stores seeing ChatGPT traffic in Q2 2026") for product improvement and public content. Aggregated data never identifies an individual store.

07Service availability

We aim for high availability but do not promise a contractual SLA at this stage. Planned maintenance is communicated in advance where practicable. The Service may be unavailable for short periods due to maintenance, upgrades, or causes outside our control (cloud provider outages, DDoS, etc.).

Tactical's snippet is designed to fail open: if our endpoint is unreachable, your storefront continues to function normally — we never block visitor traffic.

08Termination

You can cancel at any time from the dashboard. We may suspend or terminate your account, with notice where reasonable, if you breach these Terms or use the Service in a way that risks our infrastructure or our other customers. After termination we delete your data per the Privacy Policy.

09Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied, statutory — including fitness for a particular purpose, merchantability, non-infringement, and accuracy of classification or intent scoring. Agent classification is probabilistic; you should not treat it as authoritative for high-stakes business decisions without your own validation.

10Limitation of liability

To the maximum extent permitted by law, Tactical's aggregate liability under or in connection with these Terms is limited to the greater of (a) the fees you paid us for the Service in the 12 months preceding the claim, or (b) US$100. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, or data loss, even if advised of the possibility.

This limitation does not apply where excluded by applicable law.

11Indemnification

You agree to indemnify and hold Tactical harmless from claims arising out of your use of the Service in breach of these Terms, your storefront's compliance with local law (consumer protection, tax, etc.), or your collection of visitor data on the storefront where Tactical is installed.

12Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you're a consumer in a jurisdiction where local mandatory consumer-protection law gives you different rights, those rights are not waived by this section.

13Changes to these terms

We may update these Terms from time to time. Material changes will be communicated to account owners by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
